1. Agreement
These terms apply to services provided by [studio legal entity] ("GameBuilders", "we") and to purchases made through the Unity marketplace. Submitting an inquiry or purchasing a product means you accept them. Written statements in a signed scope, quotation or invoice take precedence where they conflict with this page.
2. Services
We provide three things: custom game development, licensed ready-made Unity projects, and authorized game recovery and technical reconstruction. Each engagement is defined by a written scope that lists deliverables, platforms, milestones and acceptance criteria.
3. Quotations and scope
Quotations follow a technical review of the requirement and are project-based. Where a requirement cannot be defined without investigation, we quote a paid discovery or assessment step rather than estimating against unknown scope. Work added after a scope is agreed is quoted as a change before it starts.
4. Client responsibilities
You are responsible for supplying accurate requirements, timely feedback and decisions at milestone points, and for confirming that you own or are authorized to use any material you provide. Delays caused by outstanding decisions or materials may move agreed dates.
5. Fees and payment
Fees are payable against milestones or, for marketplace purchases, at checkout. Amounts, currency, taxes and due dates are stated on the quotation or invoice. Work may be paused where an invoice is overdue, and delivered material remains licensed rather than transferred until payment is complete.
6. Intellectual property
On full payment of a custom development engagement, you own the bespoke deliverables we create for it. We retain ownership of our pre-existing tools, frameworks, internal libraries and know-how, and grant you a perpetual licence to use them as embedded in the delivered work. Marketplace purchases are licensed under the Product Licence, not sold. Third-party assets and plugins remain governed by their own licences.
7. Game recovery engagements
Recovery work requires that you own the project or hold appropriate written authorization, and we may request evidence of it. We do not work on projects belonging to another developer without their permission, we do not extract or reuse another developer's proprietary assets, and we never guarantee perfect recovery of original source code from a compiled build. Feasibility, scope and outcome depend on the files supplied and their condition.
8. Confidentiality
Each party keeps the other's confidential information private and uses it only for the engagement. Confidentiality does not cover information that is public, independently developed, or required to be disclosed by law. We sign a separate NDA on request.
9. Warranties and disclaimers
We warrant that our work is performed with reasonable skill and care and substantially as described in the agreed scope. Beyond that, we make no warranty about commercial performance, market success, third-party platform approval, or the completeness of any recovery. Marketplace products are provided as documented, without warranty of fitness for a particular purpose unless agreed in writing.
10. Limitation of liability
To the extent permitted by law, our aggregate liability for any engagement is limited to the fees paid for that engagement, and we are not liable for indirect or consequential loss, including lost profit, lost data or lost opportunity. Nothing in these terms excludes liability that cannot lawfully be excluded.
11. Termination
Either party may terminate an engagement in writing. You pay for work completed and milestones delivered up to termination; we deliver work already paid for. Licences granted under the Product Licence survive termination of unrelated engagements.
12. Governing law and changes
These terms are governed by the laws of [jurisdiction], and the courts of [jurisdiction] have exclusive jurisdiction. We may update these terms; the version in force is the one published when you engage us or place an order.
